PLEASE READ THESE SHIPPING PROTECTION TERMS (THESE “TERMS”) CAREFULLY. As an additional optional benefit for our Customers, NoMoLotus, LLC (“Us” or “We” or “Our”) provides shipping protection on certain eligible orders of our products from Customers using our website or any other website owned, operated by or behalf of Us or any of Our affiliates (collectively the “Site”). If you chose to purchase shipping protection and such purchase is eligible for shipping protection, then in addition to the Site’s Terms & Conditions (“Site Terms & Conditions”), your order will be subject to these Terms, which we reserve the right to modify, change or discontinue at any time. When changes are made to these Terms, we will provide notice by making a new copy of these Terms available at the Site. We will also update the “Last Updated” date at the top of these Terms. All the terms and conditions of the Site Terms & Conditions are incorporated herein by reference, including but limited to the sections entitled: (i) Disclaimers, (ii) Limitation of Liability; (iii) Indemnification; and (iv) Arbitration Agreement. SHIPPING PROTECTION

Subject to certain eligibility requirements, We offer customers and users of our Site (collectively, “Customers”) shipping protection for select products purchased by such Customer from Our Site. The Customers have the opportunity, not the obligation, to purchase the shipping protection services to items, merchandise and products purchased and shipped from Our Site. FOR THE AVOIDANCE OF DOUBT, BOTH THE CUSTOMER AND ANY OTHER USER OF THE SITE EXPRESSLY ACKNOWLEDGE AND AGREE THAT (A) THE VALUE COVERAGE PROVIDED BY THE SHIPPING PROTECTION IS NOT AND SHALL NOT CONSTITUTE INSURANCE OF ANY KIND WHATSOEVER; (B) IN THE EVENT OF ANY LOSS OR DAMAGES OF THE PRODUCTS PURCHASED BY THE CUSTOMER, UPON FINAL DETERMINATION BY US THAT THE PRODUCT(S) OR ITEM(S) PURCHASED BY THE CUSTOMER WERE, IN FACT, DAMAGED OR LOST, WITH SUCH DETERMINATION BEING MADE IN OUR SOLE AND ABSOLUTE DISCRETION, CUSTOMER WILL BE PROVIDED WHICHEVER IS LESSER IN VALUE OF THE FOLLOWING:

DECLARED VALUE

“Declared Value” shall mean the cost of the product, merchandise or item as stated by the Site when purchased by the Customer. This does not include any shipping or tax costs.

Procedure for Shipping Protection

Notice Timeline: Customers must notify Us of any lost or damaged products, for which shipping protection has been purchased, within 90 days of the date that such product(s) were purchased from the Site. Customers acknowledge and agree that if the Customer fails to provide timely notice as provided above, the Customer will not be provided any benefits of the shipping protection service and will not receive any refund of Customer’s purchase of the same. Upon receiving such notice, We will respond as soon as reasonably practicable.

Replacement

In the event that We determine that we will replace a lost or damaged product or item, We will determine, in Our sole discretion, the method of processing and shipping the replacement product or items.
